Complying with the WEEE Directive
The EU WEEE (Waste Electrical and Electronic Equipment) Directive came into force in August 2005, and was transposed and implemented in the form of the UK WEEE Regulations in January 2007. Its main purpose is to encourage the segregation of waste electrical items from the general waste stream and into reuse, recovery and recycling routes.
Put simply, the WEEE directive places an obligation on companies who place electrical items onto the UK market to fund their environmentally responsible disposal through government approved compliance schemes.
Although KYOCERA is legally obliged to contribute to the cost of a producer compliance scheme, our customers are not obliged to use it. As the IT recycling industry has matured, asset recovery services have emerged that are preferable to producer compliance schemes, both commercially and in terms of implementing the waste hierarchy. Products consigned to a producer compliance scheme are immediately deemed to be "end of life" when, in fact, they may simply be surplus to requirements and it would be environmentally preferable to donate them to charity or sell them as second-hand. Even non-working machines will often contain a number of viable parts that could be re-used.
A professional IT asset recovery industry now exists and reputable companies operating in this sector specialise in generating revenue from re-use of whole products, spare parts or materials. In many cases, such a service is free to the user because there is sufficient value in the materials contained in ewaste to sustain the asset recovery business; indeed some asset recovery companies make a donation to charity in respect of the value recovered. Companies should be aware that they have a duty of care to ensure that WEEE is disposed of only through licensed operators, therefore if choosing this method of disposal should only use a provider that is registered with the Environment Agency as a T11 treatment facility and can provide the appropriate duty of care certificates.
Who is obligated?
As a supplier of B2B printers and multifunctionals, KYOCERA Document Solutions is responsible for funding the environmentally-appropriate disposal of printers and multifunctionals it placed on the market on or after 13th August 2005. These can be identified by the presence of a label showing a crossed out wheeled bin symbol with a black bar underneath.
The rules are different for so-called "historic WEEE", put on the market prior to 13th August 2005 and lacking the crossed out wheeled bin symbol. The final holder of these devices is responsible for funding appropriate disposal, unless replaced on a like-for-like basis by an equivalent product in which case the producer of the replacement product is liable. In reality, this so-called "historic WEEE" has almost entirely been retired from use by now.
To meet our legal obligations and provide the operational services for WEEE recycling of printers and multifunctionals, we have registered with the Producer Compliance Scheme, B2B Compliance.
If you wish to dispose of KYOCERA equipment through B2B Compliance please contact them direct to make the arrangements. You will be asked to complete a short questionnaire form and provide a proof of purchase (in the form of an invoice or delivery note) if you have purchased new Kyocera product to replace an "historic WEEE" product. If you require the equipment to be collected from your premises, you will be provided with a quotation for the cost of this. Disposal of the equipment is at the expense of Kyocera.
